Restraining orders take away more liberty, property, and family rights than all but the most serious criminal cases. The defendant (the person it is against) can't go home, can't see his children, can't try to work things out with the other person, and can't go certain places. Any violation of the order is a crime, and can result in being thrown in jail for up to 2 1/2 years, for doing something as simple as sending a text to the "victim."
Defendants lose their children, their gun rights, their property, their jobs, their freedom to travel, their businesses, and a normal life. They have to look over their shoulder all the time to make sure the "victim" is not near. Friends and neighbors give them the evil eye. Family believes the "abuse" label.
The laws and process used to issue these orders are a violation of all of our traditional notions of legal fairness and due process. All a person has to do is tell a judge she has "fear", and the court usually issues the order. Once issued, they are almost impossible to terminate, because judges don't want to re-hash the false allegations that were used to get them in the first place.
